These Terms & Conditions (hereinafter, the "Terms") govern the hiring of the web maintenance services offered at https://kalnet.tech by Caleb Abraham Lango Villada, a sole proprietor registered under Mexico's Simplified Trust Regime (RESICO) operating commercially under the brand "Kalnet" (hereinafter, the "Company" or "Kalnet").
By hiring the web maintenance service (hereinafter, the "Service"), you (hereinafter, the "Client") accept and agree to comply with these Terms. If you do not agree with them, you must refrain from hiring or using the Service.
01Purpose and acceptance
Hiring or using the Service constitutes the Client's full and unreserved adherence to these Terms. Through the Service, the Company makes available to the Client website maintenance, update, and technical support activities, in accordance with the plan and scope hired.
The Client acknowledges that some Services require prior hiring, activation, or payment, and that not all of them are available in every geographic area.
02Scope and restrictions of the Service
The Service will be provided only for the website indicated by the Client during the hiring process. If the Client requires maintenance for a different site, a new Service must be hired.
The Service covers maintenance tasks of a simple nature, within the number of hours or scope of the plan hired. The Company is not obligated to carry out major changes, redesigns, new development, or tasks that exceed the hired hours or scope; such activities may be quoted separately.
The number of hours consumed by changes and modifications will be determined by the Company based on reasonable and commercial criteria, and the Client will be informed.
The Client agrees to use the Service in accordance with the law, good practice, the rights of third parties, and internet usage standards, and not to interfere — through software, devices, or any other means — with the operation of the Service, its databases, or its information.
The Service is for the Client's individual use; it may not be resold or commercialized without the Company's express written authorization.
03Intellectual property
The intellectual and industrial property rights over the Company's own tools, methodologies, distinctive signs, and domains belong exclusively to the Company. Neither the Client nor third parties acquire any right over such tools by hiring the Service.
Content, materials, text, images, databases, and elements the Client provides for the Service are and will remain the Client's property; the Client represents it holds the necessary rights to use them and releases the Company from any third-party claim in that regard.
The foregoing applies equally to the intellectual property rights of third parties that may be linked to or presented through the Service.
04Warranties and liability
The Service is provided "as is" and "as available." The Company provides the Service with a reasonable level of skill and commercial diligence, but does not guarantee uninterrupted availability or the total absence of errors.
Recommendations and advice obtained through the Service are general in nature and do not replace the advice of a specialized professional for the Client's specific needs.
To the maximum extent permitted by applicable law, the Company will not be liable for damages arising from: inaccuracies, typographical errors, temporary unavailability, periodic changes or improvements, or the Client's use of the Service, which is at the Client's own risk.
Limitation of liability. The Company's total liability to the Client, for any matter related to the Service, will in all cases be limited to the amount actually paid by the Client for the Service period in which the claim originated.
The Client agrees to hold the Company, its affiliates, representatives, and collaborators harmless from any liability, claim, or expense arising from the Client's breach of these Terms or misuse of the Service.
05Term, pricing, and payment
Term. The Service has the term specified at the time of hiring, which may be monthly or yearly. The term will be stated through the communication channels established during the purchase process or in the payment receipts the Company sends the Client.
Pricing. Prices are those in effect at the time of hiring and, where indicated, will include applicable taxes. The Company may update its prices for future renewals, giving reasonable advance notice.
Payment method. Payments may be made by bank transfer, credit or debit card, or other means enabled by the Company. In all cases, payment must be made in full, prior to the start of the Service.
Payment processor. Card payments are processed through Stripe, Inc., which collects and processes card data directly on its own servers. The Company does not store the Client's complete card data. Such processing is further governed by Stripe's policies and by our Privacy Policy.
Renewals. Recurring Services will renew according to the term hired, unless the Client notifies its cancellation under the applicable Policy.
06Refunds, returns, and cancellations
Refund, return, and cancellation terms are governed by the Refunds & Cancellations Policy, which forms an integral part of these Terms. In summary:
- Once the Service has started, the payment made is non-refundable, in whole or in part, except as provided in that Policy.
- The Client may cancel the Service at any time; cancellation takes effect going forward and does not generate a refund of the amount already paid for the current period.
- From the point of cancellation, the Company will not be liable for incidents, damage, or vulnerabilities occurring on the website as a result of the interruption of maintenance; that responsibility falls on the Client.
07Third-party goods and services
Any reference or link to information, goods, or services of third parties within the Service does not imply a recommendation, warranty, sponsorship, or endorsement by the Company. The Company will not be liable for the availability, sale, delivery, or provision of goods or services offered by third parties or linked sites.
08Confidentiality
The Company agrees to keep confidential any information it receives from the Client that has that character, in accordance with applicable law in the United Mexican States. Reciprocally, the Client agrees to keep confidential the Company's methodologies, tools, and prices that are not publicly known.
09Personal data and cookies
Processing of the Client's personal data is governed by our Privacy Policy, and the use of cookies and tracking technologies by our Cookies Policy, both available on the website and which the Client declares to know and accept.
10Access credentials and accounts
The Client is solely responsible for keeping secret the access credentials used to access the Service, as well as for all activity carried out through their account.
By creating an account, the Client represents, under penalty of perjury, that they are at least 18 years old or have reached legal age in their jurisdiction, and accepts these Terms and the Privacy Policy.
11Changes to these Terms
The Company may modify these Terms at any time. Modifications will be published at https://kalnet.tech and will indicate the date of the last update. The Client is encouraged to review them periodically. Certain Services may be subject to particular conditions that complement or modify these Terms.
12Governing law and jurisdiction
For the interpretation, performance, and enforcement of these Terms, the federal laws of the United Mexican States will apply, and the courts of the State of Mexico will have jurisdiction; the Client expressly waives any other forum or jurisdiction that might correspond to them by reason of their present or future domicile or any other cause. This is without prejudice to the rights the Client may have as a consumer under Mexico's Federal Consumer Protection Law and the jurisdiction of PROFECO. If you are contracting from outside Mexico, this governing-law clause does not limit or waive any consumer-protection rights you may have under the law of your own country — it only fixes Mexico as Kalnet's home jurisdiction for disputes not otherwise resolved directly with us.
